TERMS AND CONDITIONS

Institute of Professional Drivers & Chauffeurs will herein be known as ‘IoPDC’.

The following Terms and Conditions govern your use of the Web Site (the “iopdc.com site”) and your relationship with IoPDC. By using the iopdc.com site you agree to be bound by these Terms and Conditions. These Terms and Conditions may change without further notice to you and IoPDC recommend you check the Terms and Conditions when you use the iopdc.com site.

Reliance
All information included on the iopdc.com site is intended for information purposes only and does not represent advice. We make no representations or warranties as to the accuracy of the Information contained on the iopdc.com site, and you should take appropriate precaution to verify it.

We cannot agree that the service will be fault free. If a fault occurs in the service we will attempt to correct the fault as soon as we reasonably can. Your access to the site may be occasionally restricted to allow for maintenance.

Our Liability
Whilst we endeavour to ensure that information on the iopdc.com site is correct, we shall not be liable for any damages arising from the use or inability to use the iopdc.com site or any information contained on it or from any action or decision taken as a result of using the iopdc.com site or any such information.

To the maximum extent permitted by applicable law we disclaim liability for all implied or statutory warranties and conditions. We do not exclude liability for death or personal injury.

Password & Security
Once IoPDC has agreed your membership you will be able to register to use the iopdc.com site where you will be asked to create a password. You must keep this password confidential and must not disclose it or share it with anyone. If you know or suspect that someone else knows your password you should notify us immediately. Failure or misuse of this service may result in revoking your membership.

Goods and Services
Registered members that use iopdc.com site may be able to purchase goods and services such as publications, memorabilia, collectable items and certain branded merchandise as well as those from the institutes subsidiaries or related companies including The Corporation of Professional Drivers & Chauffeurs .This should not be confused with the purchase of goods and services from third party sites linked to the iopdc.com site. Prices and availability of goods and services are subject to change. In the event that we are unable to supply you the goods or services you will receive a full refund.

While we try and ensure that all prices on the iopdc.com site are accurate, errors may occur. If we discover an error we shall inform you as soon as possible and once notified you have the option of reconfirming the order at the correct price or cancelling. If having already paid for the goods or services and you choose to cancel, you will receive a full refund.

Compensation
You hereby undertake, as a condition of use of the iopdc.com site, to indemnify us against any loss or damaged suffered by us as a result of any breach by you of any of these Terms and Conditions.

Termination
IoPDC may terminate your use of the iopdc.com site and membership at any time without notice.

Third Party Sites
The iopdc.com site contains links to third party resources on the web. We are not responsible for any third party’s products, services, omissions or acts. There is no connection or association between IoPDC and the third party unless otherwise stated, other than the provision of the link. We do not act in partnership with nor as agent for or on behalf of the third party to whom we provide links. Accordingly, neither party may incur any debt or liability on behalf of the other party.

Law
These Terms and Conditions and any disputes arising from or in connection with them shall be governed by the law of England and all parties submit to the exclusive jurisdiction of the English Courts. We do not make a promise that the materials on the iopdc.com site are appropriate or available for use in locations outside the United Kingdom, and using the iopdc.com site from territories where its use or contents is unlawful is prohibited.

Notification of changes
The IoPDC reserves the right to modify, alter or otherwise update this Policy at any time and users are encouraged to review this Policy from time to time. Any changes to the Policy will be highlighted on the iopdc.com homepage and previous Policy will be available on iopdc.com for at least six months after the change has come into effect.

Force Majeure Clause
No Party shall be liable for any failure to perform its obligations where such failure is as a result of Acts of Nature (including fire, flood, earthquake, storm, hurricane or other natural disaster), war, invasion, act of foreign enemies, hostilities (whether war is declared or not), civil war, rebellion, revolution, insurrection, military or usurped power or confiscation, terrorist activities, nationalisation, government sanction, blockage, embargo, labour dispute, strike, lockout or interruption or failure of electricity or [telephone service], and no other Party will have a right to terminate this Agreement in such circumstances."
"Any Party asserting Force Majeure as an excuse shall have the burden of proving that reasonable steps were taken (under the circumstances) to minimise delay or damages caused by foreseeable events, that all non-excused obligations were substantially fulfilled, and that the other Party was timely notified of the likelihood or actual occurrence which would justify such an assertion, so that other prudent precautions could be contemplated."


Feedback/forum

The feedback forum on the IoPDC’s website is a place to record a companies/drivers profile, to view their reputations and to express your opinions by leaving feedback on the service, i.e. standard of driver, vehicle, dress code, method and speed of payment. When using the forum please ensure that you are civil, respectful and relevant in your message. Your posts and responses are for the purpose of requesting and offering helpful advice, commenting on current issues and sharing information and experiences on relevant professional subjects. Please ensure that you are careful when using ambiguous language or humour that may inadvertently offend and that you do not make unwarranted criticism, abusive or libellous comments about other people or organisation, commercial or non-commercial. You do not advertise your services, or the services of any company or organisation with which you are associated, you do not include any personal contact information (e.g. telephone, email, company) within the body of your posting. You do not distribute text or graphics that are copyright protected unless you have clear permission to do so. The IoPDC does not accept any liability for views, opinions or advice expressed by users contributing to the forum on our website.

If you feel that the behaviour in the feedback/forum is unacceptable for any reason, contact the IoPDC privately by e-mail to raise your concerns.

The IoPDC does not accept any liability for views, opinions or advice expressed by users contributing to the forum. The IoPDC reserves the right to remove content and postings which in the IoPDC’s opinion does not observe the feedback/forums terms and conditions.

Legal Helpline

IoPDC will be monitoring the usage of the legal helpline by it’s members and reserves the right to impose a fee if the usage is found to be above a reasonable rate.
